Feds Found 100% Mail-in Vote Samples Were Noncitizens in California- Update
Update: California US Attorney Bill Essayli will file an emergency appeal, but I imagine it’s likely too close to the election for the Court to act.
@TheJusticeDept is committed to seeking a court order to separate the suspected 20,000 noncitizen ballots from lawful ballots. This is necessary because California is already processing hundreds of thousands of ballots that cannot be undone.
Segregating a ballot does not prevent it from being counted later. It is designed to preserve the status quo and prevent the infection of our election with illegal ballots. https://t.co/ttE4HWm1zj

The federal civil rights lawsuit United States of America v. State of California et al. was filed in the U.S. District Court for the Central District of California to compel California and Los Angeles County election officials to set aside vote-by-mail ballots from more than 20,000 individuals flagged by federal agencies as likely noncitizens.
The DOJ argues that federal law (18 U.S.C. § 611) prohibits noncitizens from voting in federal elections. They insisted that these ballots should be held until their citizenship can be independently or jointly verified.
California state officials have rejected the request. They say they are concerned about the reliability of the federal government’s data. They argue that the federal government lacks authority to disrupt active ballot counting close to the midterm elections.
On Monday, October 26, 2026, a three-judge panel for the 9th U.S. Circuit Court of Appeals ruled 2-1 against the government’s emergency request. The majority denied the request to sequester the 20,000 ballots. They said the DOJ’s eleventh-hour lawsuit risked confusing voters and upending state policies.
The administration has not yet filed an appeal.
Secure voting is not a high priority in far-left California.
LA County says a sample of the Trump administration’s 200 names of suspected non-citizen voters showed that 38.9% attested to being born in the US. But in a new sworn statement under penalty of perjury, a DHS official says its investigation shows NONE of LA County’s 200 names were born in the US. Upon further review, four might have a claim to citizenship.
“After a thorough review of the immigration records of all the individuals on the County’s Sample List, it was determined that none of the individuals USCIS matched to the County’s Sample List were born in the United States according to USCIS records,” -Nicolas Bartell, Associate Director of Fraud Detection at USCIS.

The Democrats are lying about this:
That’s not true. LA County sampled 200 names from our list and claimed 38% were U.S.-born based on their registration forms. We reviewed their work and confirmed with USCIS that all 200 were foreign-born nationals, so the claim dropped from 38% to 0%. Read the declarations in evidence explaining this.
