9th Circuit Reverses Restrictions on Pressuring States Over Ineligible Voters

It’s good I didn’t post this earlier, or I’d have to correct it three times. The Ninth Circuit three-judge panel voted 2 to 1 to remove the block on pressuring California to put the 20,000 potential illegal voters aside. The DOJ can threaten them with prosecution.

Then the full Ninth Circuit met and blocked its own three-judge ruling. However, the Ninth Circuit reversed the latter ruling. They will now allow the three-judge panel’s ruling to stand.

The case could now head to the Supreme Court on appeal. The Supreme Court rejected an emergency appeal, with Justice Kagan deciding it.

The Ninth Circuit is lifting restrictions on the Trump administration’s efforts to have states set aside suspected noncitizen ballots, allowing it to resume such requests and warn election officials of prosecution.

It also suspends requirements that the administration disclose certain pending warrants and grand jury subpoenas involving allegedly ineligible voters, as well as a requirement to notify election officials of the district judge’s order.

It’s the third order in 12 hours.
